Interpretation and Definitions

Interpretation

Words with an initial capital letter have meanings defined below. These definitions apply whether the terms appear in singular or plural form.

Definitions

  • Company (referred to as “we,” “us,” or “our”) refers to CarfaxLess, operator of carfaxless.com.
  • Service refers to the CarfaxLess website and all vehicle history report services offered through it.
  • Website refers to CarfaxLess, accessible at https://carfaxless.com.
  • You means the individual accessing or using the Service, or the legal entity on whose behalf such individual is acting.
  • VIN means Vehicle Identification Number, a unique 17-character code used to identify a specific vehicle.
  • Report means a vehicle history report generated by CarfaxLess based on a submitted VIN.
  • Device means any device capable of accessing the Service, such as a computer, smartphone, or tablet.
  • Third-Party Services means any external services, tools, or content integrated with or linked from the Website.

Acceptance of Terms

By accessing or using CarfaxLess, you confirm that:

  • You have read, understood, and agree to be bound by these Terms and Conditions
  • You are at least 18 years of age
  • You are using the Service for lawful purposes only
  • You have read and agree to our Privacy Policy

If you do not agree to these Terms, you may not access or use the Service.

Description of Service

CarfaxLess provides consumers with access to vehicle history reports based on submitted VIN numbers. Our reports may include information such as accident history, title records, odometer readings, and other vehicle data sourced from third-party data providers.

Important: CarfaxLess is an independent service and is not affiliated with, endorsed by, or a substitute for Carfax® or any other vehicle history report provider. “Carfax” is a registered trademark of Carfax, Inc.

Use of the Service

Permitted Use

You may use CarfaxLess solely for personal, non-commercial purposes, including:

  • Looking up the history of a vehicle you are considering purchasing
  • Verifying information about a vehicle you own
  • Any other lawful consumer use

Prohibited Use

You agree not to:

  • Use the Service for any unlawful, fraudulent, or deceptive purpose
  • Submit false, misleading, or fabricated VIN numbers
  • Attempt to scrape, crawl, or bulk-download data from the Website
  • Resell, redistribute, or commercialize any reports obtained through the Service without written permission
  • Interfere with or disrupt the security, integrity, or availability of the Website
  • Use automated tools, bots, or scripts to access the Service
  • Violate any applicable federal, state, or local laws or regulations

We reserve the right to terminate access for any user who violates these terms.

Orders, Payments, and Refunds

Placing an Order

When you submit a VIN and complete a purchase, you are placing an order for a vehicle history report. Orders are processed immediately upon payment confirmation.

Payment

All payments are processed securely by Stripe. By completing a purchase, you agree to Stripe’s Terms of Service and Privacy Policy. CarfaxLess does not store your full credit card information on its servers.

Report Delivery

Reports are delivered digitally, typically within seconds of payment confirmation. By completing your purchase, you acknowledge that the Service has been rendered immediately and electronically.

Refund Policy

Because vehicle history reports are delivered digitally and instantly, all sales are final. We do not offer refunds once a report has been delivered.

However, if you experience a technical issue that prevented delivery of your report, please contact us at support@carfaxless.com within 7 days of your purchase and we will investigate and work to resolve the issue.

Accuracy of Reports and Data Disclaimer

CarfaxLess sources vehicle history data from third-party data providers. While we strive to provide accurate and up-to-date information:

  • We do not guarantee the completeness, accuracy, or timeliness of any report
  • Vehicle history data depends on whether incidents were reported to official databases; unreported events will not appear in reports
  • Reports should be used as one tool among many when evaluating a vehicle — not as a sole basis for purchase decisions
  • We strongly recommend obtaining an independent mechanical inspection before purchasing any used vehicle

CarfaxLess is not liable for any decisions made based on information contained in a vehicle history report.

Intellectual Property

All content on CarfaxLess, including but not limited to text, graphics, logos, interface design, and software, is the property of CarfaxLess or its licensors and is protected by applicable copyright and intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any content on this Website without our prior written consent.

Vehicle history data contained within reports is sourced from third-party providers and remains subject to their respective ownership and licensing terms.

The Website may contain links to third-party websites or services. CarfaxLess has no control over and assumes no responsibility for the content, privacy practices, or terms of any third-party sites. We encourage you to review the terms and privacy policies of any external sites you visit.

Termination

We reserve the right to suspend or terminate your access to the Service at any time, without prior notice, if we determine that you have violated these Terms or engaged in conduct that is harmful to CarfaxLess, other users, or third parties.

Upon termination, your right to use the Service will cease immediately. Provisions of these Terms that by their nature should survive termination will continue to apply.

Limitation of Liability

To the maximum extent permitted by applicable law, CarfaxLess and its affiliates, officers, employees, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, goodwill, or business opportunity — arising out of or related to your use of the Service.

In all cases, CarfaxLess’s total liability to you for any claim arising from or related to this Service shall not exceed the amount you paid for the specific report that is the subject of the claim, or $50 USD, whichever is greater.

Some states do not allow limitations on implied warranties or liability for incidental damages. In such states, liability will be limited to the greatest extent permitted by law.

Disclaimer of Warranties

The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

  • The Service will be uninterrupted, error-free, or secure
  • Reports will be complete, accurate, or current
  • Any defects or errors will be corrected

Your use of the Service is at your sole risk.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the United States, without regard to conflict of law principles. For users in states with specific consumer protection laws (including California), those mandatory protections continue to apply.

If you have a dispute with CarfaxLess, you agree to first contact us at support@carfaxless.com and attempt to resolve the matter informally. If a resolution cannot be reached within 30 days, either party may pursue available legal remedies.

For Canadian Users

If you are a resident of Canada, your use of the Service is also subject to applicable Canadian federal and provincial laws, including PIPEDA.

Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. Any waiver of a specific breach does not constitute a waiver of any subsequent breach.

Changes to These Terms

We may update these Terms from time to time. If changes are material, we will update the “Last updated” date at the top of this page and, where appropriate, notify users by email or a notice on the Website at least 14 days before the changes take effect.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms.
